Do I Need a Lawyer to Buy a House in Sellersburg, IN?

No. Indiana does not require you to hire a lawyer to buy a house in Sellersburg, and most buyers close with a title company and their agent instead. Some buyers still choose a real estate attorney when a contract or title question goes beyond the usual.

Here's how it usually works in Sellersburg, Clark County, Indiana.

Who Does What When You Buy in Sellersburg

Your agent. Your agent helps you write the purchase agreement. That's the contract that sets the price, the dates and the conditions, like an inspection or loan approval. Agents can't give legal advice.

The title company. A title company checks the public records to make sure the seller really owns the home and that old loans or liens get paid off. It also sells title insurance, which protects you if an old claim on the property turns up later. At closing, it collects the money and sends the deed to be recorded.

The Clark County Detail: Your Deed Has Three Stops

Sellersburg is a town inside Clark County, so your deed is recorded by the county, not the town. Before the Clark County Recorder's Office will record it, the deed is reviewed by the Assessor's Office (Room 104) and transferred by the Auditor's Office (Room 106). All three offices are at 300 Corporate Drive in Jeffersonville.

The deed must name who prepared it, include the grantee's address (that's you, the buyer), carry a full legal description of the land, and include a signed statement that Social Security numbers were removed. The recording fee for a deed is $25.

A state form rides along too. The Indiana sales disclosure form is filed with the county auditor and carries a $20 fee. Per the Indiana Department of Local Government Finance (DLGF), the auditor may not accept the transfer if that form is incomplete.

The title company usually handles all of this. If you buy without one, a missing line can hold up your deed.

When Buyers Choose to Hire a Lawyer

Some buyers bring in a real estate attorney for situations like these:

  • Buying from a family member or a friend with no agent or title company
  • Seller financing, where the seller acts as the bank
  • A title search that turns up a boundary problem, an old lien or a missing heir
  • Questions about how to hold title with a spouse, partner or trust

This isn't legal advice. If your purchase has any of these pieces, talk with an Indiana real estate attorney or a title company before you sign.

A Tip From a Local Agent

Read your title commitment the day it shows up. That's the report the title company sends before closing, and it lists anything recorded against the property. Most of it is routine. If something doesn't make sense, that's the moment to ask a lawyer, not the morning of closing. I'd rather see a Sellersburg buyer spend an hour with an attorney early than push a closing date.
